We know how the juvenile justice systems works and can ensure that your case is handled properly and with the care it deserves.
How Does the Juvenile Justice System Work?
The first thing to remember is that the juvenile justice system focuses primarily on rehabilitation as opposed to punishment. Juveniles taken into custody also have certain rights, such as the right to remain silent, to hire an attorney, to be advised of what they are being charged with, to be able to review the evidence being used against them, to be able to face their accusers, and to have a trial.
When taken into custody at a Juvenile Assessment Center, a juvenile is interviewed by a counselor who will create a risk assessment report. This report will determine whether the juvenile will need to remain in a detention center or be released to his or her parents. If the juvenile is held in secured detention, it will be reviewed by a judge who will make a further ruling on the matter. Juveniles in detention will remain so for 21 days or until the case is closed.
After that, if formal charges are filed, the case will be subject to the ruling of a juvenile judge.
Many diversionary programs are available to juveniles that can include:
- Drug treatment programs
- Community service
Parikh Law can thoroughly review all of the evidence being used in your child’s case and provide explanations to you of possible defenses based on the facts and circumstances. We can then go on to defend your son or daughter before the judge.
